The Free State of Bavaria promotes the construction and modernization of rental apartments for those eligible for social housing assistance. The selection of new construction projects to be subsidized is based on the urgency of local housing needs. In return for the funding, the subsidized apartments are subject to housing restrictions, which can restrict both the authorized users (owners) and tenants in the use of the properties. The most important restrictions here are occupancy and rent control.
The district administrations, independent cities, large district towns or "large delegation municipalities" are responsible for enforcing the housing commitment. They ensure the intended use of subsidized housing in their area (including subsidized owner-occupied housing that is to be rented out during the commitment period). This includes the occupancy of the apartment by authorized tenants, compliance with the permissible rent level and, for example, issues relating to the expiry of the commitment and the conversion of social rental apartments into owner-occupied apartments. They pursue violations of the housing commitment and, if necessary, evict tenants.
