If subsidized housing is to be exempted from occupancy restrictions for a limited period, this must be applied for.
Description
Social rental housing is subject to occupancy restrictions. This creates an obligation for the person entitled to dispose of the subsidized rental accommodation to only let it to people who meet certain requirements.
In individual cases, there may be sufficient reasons to permit the transfer or use of tied housing in derogation of the occupancy restrictions. To this end, an application must be made to exempt the socially tied housing from occupancy restrictions. In contrast to a release from the ties, the exemption can only be granted for a limited period of time.

The competent authority may temporarily release the person entitled to dispose of the property from occupancy obligations if
- there is no longer an overriding public interest in them or
- adherence to these is no longer required due to an overriding public interest, in particular the creation or maintenance of socially stable resident structures or an overriding legitimate private interest.
