Statutes on the use of the Ambach recreation area (eastern shore of Lake Starnberg)

On the basis of Art. 17 and 18 Para. 1 Nos. 1 and 2 of the County Code for the Free State of Bavaria in the version published on August 22, 1998, the County of Bad Tölz-Wolfratshausen issues the following statutes (with incorporated amendment statutes from January 2005):


§ 1 Object of the Articles of Association

(1) The statutes apply to the Ambach recreation area managed by the district of Bad Tölz-Wolfratshausen with the exception of the parking lots. It is divided into a northern and southern part and comprises the following parcel numbers (Fl.Nr.), all located in the district of Holzhausen am Starnberger See:
Northern part: Fl.Nr. 1555 and 1537
Southern part: Fl.Nr. 1543, 1792, 1793/2, 1796 and 1797/3.


(2) The boundaries of the recreation area are as follows:
Northern part: From the intersection of the northern property boundary of parcel no. 1555 with the eastern shore of Lake Starnberg along the northern and eastern property boundary of parcel no. 1555 to the intersection with the northwestern boundary of parcel no. 1500/3 (Hirth campsite access road). Continue in a southerly direction along this road to the intersection with the southern boundary of parcel no. 1537, from there continue in a westerly direction to the intersection with the eastern shore of Lake Starnberg.
Southern part: From the intersection of the northern boundary of parcel no. 1543 with the eastern shore of Lake Starnberg along the northern boundary of parcel no. 1543 to the intersection with the western boundary of parcel no. 1797/3, continue in a westerly direction to the intersection with the eastern shore of Lake Starnberg.No. 1797/3, further in a northerly direction to the shoreline of the Schwaiblbach (plot no. 1546), along its southern shore to the intersection with the western boundary of plot no. 1500/1 (St 2065), further along the western boundary of plot no. 1500/1 in a southerly direction to the intersection with the southern access road, plot no. 1795, with the exception of plot no. 1797/4 (Gasthaus "Buchscharner Seewirt"). From there, continue along the eastern boundary of parcel nos. 1796 and 1792 to the intersection of this boundary with the eastern shore of Lake Starnberg.
In the west, the recreational area (southern and northern parts of the site) is bounded by the western district boundary.


(3) The recreation area is a public facility of the district of Bad Tölz-Wolfratshausen. It is made available to the public for general use free of charge
in accordance with these statutes.

§ 2 Restriction of use

(1) Persons who pose a risk to the general public (e.g. drunks, persons with infectious diseases, etc.) are not permitted to enter.

(2) Children under the age of 6 are only permitted to visit if accompanied by persons over the age of 16.

(3) Bathers may only use the recreation area in normal swimwear.


§ 3 Behavior in the recreation area

(1) Users are obliged to avoid anything that endangers the safety, order, peace and cleanliness of the recreation area.

(2) Within the recreation area, users are prohibited unless special permission has been granted by the Bad Tölz-Wolfratshausen District Office:

1. to use motor vehicles, ride bicycles or horseback, with the exception of paths and areas that are authorized for such traffic by traffic signs;

2. littering, damaging or otherwise altering the green spaces and facilities;

3. to play with hard balls (leather balls) outside the areas expressly authorized for this purpose;

4. to cause a nuisance to other visitors, in particular by operating radio and tape recorders, record players and musical instruments or by making other noise;

5. to barbecue or light open fires, except in the fireplaces set up for this purpose;

6. to spend the night, camp and set up caravans;

7. to bring in sailboats over 100 kg empty weight or motorboats of any kind;

8. to allow animals of any kind to enter the lake during the bathing season or to swim in the lake or to clean the lake. It is forbidden to allow animals of any kind to run free all year round. Animals are prohibited during the bathing season (15.05. to 15.09.);

9. to sell goods of all kinds, including food and drink, to offer commercial services, to take orders and to organize amusements.

(3) Paragraph 2 No. 1 does not apply to vehicles of the police, the water rescue service or other rescue services and to supply and disposal vehicles for facilities and stores in the recreation area.


§ 4 Blocking of use

(1) The recreation area and its facilities may be closed to general use in whole or in part during certain periods; in such cases, use in accordance with the closure is prohibited.

(2) Areas on which development work is being carried out are not permitted for use.


§ 5 Liability

Use of the recreation area is at your own risk at all times of the year. The district is only liable for damage of any kind within the scope of the statutory provisions.


§ 6 Arrangements

The orders issued by the supervisory staff of the Bad Tölz-Wolfratshausen District Office or the Münsing municipality to maintain safety and order in the recreation area must be complied with immediately.

The supervisory staff may expel persons from the recreation area who violate the provisions of this regulation despite a warning.


§ 7 Obligation to remove and substitute performance

(1) Anyone who causes a disorderly condition by contravening the provisions of these user regulations must remedy this immediately at their own expense without being requested to do so.

(2) If he fails to comply with this obligation, the Bad Tölz-Wolfratshausen District Office may remove the condition in his place and at his expense after a warning and after the fruitless expiry of the deadline set: a prior warning and the setting of a deadline are not required if the person subject to the obligation cannot be reached immediately or if there is imminent danger or if the immediate removal of the unlawful condition is in the urgent interest of the public.


§ 8 Administrative offenses

Who

1. uses the recreation area contrary to § 2 para. 1 and 3,

2. violates the prohibitions of § 3 Para. 2,

3. uses the recreation area despite a ban in accordance with § 4 Para. 2,

4. does not follow the instructions of the supervisory staff in accordance with § 6

can be fined on the basis of Art. 18 of the County Ordinance.


§ 9 Entry into force

The Articles of Association shall enter into force on the day following their publication.
