Statutes of the district of Bad Tölz-Wolfratshausen
"Ambach recreation area on the eastern shore of Lake Starnberg"

Based on Art. 17 and 18 Para. 1 Nos. 1 and 2 of the County Code for the Free State of Bavaria in the version published on August 22, 1998 (GVBl. p. 826, BayRS 2020-3-1-I) last amended by § 3 of the law of December 9, 2024 (GVBl. p. 573), the County of Bad Tölz-Wolfratshausen issues the following statutes:

§ 1 Object of the Articles of Association

1. these regulations apply to the Ambach recreation area managed by the district of Bad Tölz-Wolfratshausen. Excluded are the parking lots to which the "Usage statutes of the district of Bad Tölz-Wolfratshausen for the parking lots at the Ambach recreation area on Lake Starnberg" apply. It is divided into a northern and southern part and comprises the following parcel numbers (Fl.Nr.), all located in the Holzhausen am Starnberger See district:

• Northern part: plot nos. 1555, 1460/2 (TF) and 1537
• Southern part: parcel nos. 1543, 1792 (TF), 1793/2 (TF), 1796 and 1797/3.

2. the boundaries of the recreation area are shown on the attached maps at a scale of 1:5,000 and 1:10,000. The maps are an integral part of these bylaws. The maps (map part 1 - northern area, map part 2 - southern area) at a scale of 1:5,000 are authoritative for the exact boundary of the recreation area (red marking). The maps are available for inspection during opening hours at the Bad Tölz-Wolfratshausen District Office in the Environment Department.

The boundaries of the recreation area are as follows: Northern part: From the intersection of the northern property boundary of parcel no. 1555 with the western county boundary along the northern and eastern property boundary of parcel no. 1555 to the intersection with the northwestern boundary of parcel no. 1500/3 (access road to the campsite). Continue in a southerly direction along this road to the intersection with the southern boundary of parcel no. 1537, from there continue in a westerly direction to the intersection with the western county boundary.

Southern part: From the intersection of the northern boundary of plot no. 1543 with that of the western district boundary along the northern boundary of plot no. 1543 to the intersection with the western boundary of plot no. 1797/3, continuing in a northerly direction to the shoreline of the Schwaiblbach (plot no. 1546), along its southern bank to the intersection with the western boundary of plot no. 1500/1 (St 2065), further along the western boundary of plot no. 1500/1 in a southerly direction to the intersection with the southern access road, plot no. 1795, with the exception of plot no. 1797/4 (Gasthaus "Buchscharner Seewirt"). From there, continue along the western boundary of plot no. 1795 to the intersection of the boundary of plot no. 1792 with the western district boundary.

To the west, the recreational area (southern and northern parts of the site) is bordered by the western district boundary. Parcel no. 1460/2 (Seestraße) does not divide the crossed properties.

3. the recreation area is a public facility of the district of Bad Tölz-Wolfratshausen. It is made available to the public for general use free of charge in accordance with these statutes.

§ 2 Restriction of use

1. Persons who pose a risk to the general public (e.g. drunks, persons with infectious diseases, etc.) are not permitted to enter.
2. Children under the age of 6 are only permitted to visit if accompanied by persons over the age of 16.
   
3. Bathers may only use the recreation area in swimwear.

§ 3 Behavior in the recreation area

1. Users are obliged to show mutual consideration. Anything that impairs the safety, order, peace and cleanliness of the recreation area must be avoided.
2. Within the recreation area, users are prohibited unless special permission has been granted by the Bad Tölz-Wolfratshausen District Office:

• to drive or park motor vehicles, ride a bicycle or go horseback riding, with the exception of paths and areas that have been cleared for such traffic by traffic signs
• to contaminate, damage or otherwise alter the green spaces and facilities (in particular by throwing away or leaving objects or by not removing dog excrement);
• cause noise (e.g. loud music);
• to use remote-controlled equipment (e.g. flying drones, boats, airplanes, cars, etc.) and stunt kites (especially kites) during the bathing season (15.05. to 15.09.);
• to barbecue (regardless of the form in which the barbecue is operated, e.g. electricity, coal or wood) or to light an open fire;
• to stay overnight (e.g. tent, caravan, motorhome, camper);
• Sailboats over 100 kg empty weight or motorboats of any kind;
• Animals of any kind may not enter the lake during the bathing season, swim in the lake or clean the lake. It is forbidden to allow animals of any kind to run free all year round. During the bathing season (15.05. to 15.09.) it is forbidden to bring animals;
• to operate businesses and events without a permit;
• Feeding waterfowl.

3. paragraph 2 no. 1 does not apply to rescue services, police and security services, supply and disposal vehicles for the operation of the site.

§ 4 Blocking of use

1. The recreation area and its facilities may be closed to general use in whole or in part during certain periods; in such cases, use in accordance with the closure is prohibited.
2. Areas on which construction, maintenance and care measures are being carried out are not permitted for use.

§ 5 Liability

Use of the recreation area is at your own risk at all times of the year. The district is only liable for damage of any kind within the scope of the statutory provisions.

§ 6 Arrangements

The orders issued by the supervisory staff of the Bad Tölz-Wolfratshausen District Office or the Münsing municipality to maintain safety and order in the recreation area must be complied with immediately.

The supervisory staff may expel persons from the recreation area who violate the provisions of this regulation despite a warning.

§ 7 Obligation to remove and substitute performance

1. Anyone who causes an irregular situation by contravening the provisions of these user regulations must remedy this immediately at their own expense without being requested to do so.
2. If he does not comply with this obligation, the Bad Tölz-Wolfratshausen District Office may remove the condition in his place and at his expense after a warning and after the fruitless expiry of the deadline set. A prior warning is not required if there is imminent danger or if the immediate removal of the unlawful condition is in the urgent interest of the public.

§ 8 Administrative offenses

Anyone who negligently or intentionally

1. uses the recreation area contrary to § 2 para. 1 and 2,
2. violates the prohibitions of § 3 para. 2,
3. uses the recreation area despite a ban in accordance with § 4 Para. 2,
4. does not follow the instructions of the supervisory staff in accordance with § 6

can be fined up to € 2,500 on the basis of Art. 18 of the District Ordinance.

§ 9 Entry into force

The Articles of Association shall enter into force on the day following their publication.
