Usage regulations of the district of Bad Tölz-Wolfratshausen for the parking spaces at the Ambach recreation area on Lake Starnberg
The district of Bad Tölz-Wolfratshausen issues the following statutes on the basis of Art. 17 and 18 Para. 1 No. 1 and Para. 2 of the District Code of the Free State of Bavaria (LKrO) in the version published on August 22, 1998 (GVBl. p. 826, BayRS 2020-3-1-I), last amended by § 3 of the law of December 9, 2024 (GVBl. p. 573):
§ 1 Object of the Articles of Association
- The district of Bad Tölz-Wolfratshausen operates the parking lots at the "Ambach am Starnberger See" recreation area as a public facility. They are made available to the public for general use for parking purposes in accordance with these regulations.
- The parking spaces are not dedicated as public parking spaces in accordance with the Bavarian Road and Highway Act (BayStrWG).
- The provisions of the German Road Traffic Regulations (StVO) apply.
- The parking lots include the properties parcel no. 1537 and 1555 in the north and at the main access road parcel no. 1797/3 of the Holzhausen district, Münsing municipality. The attached plans with the red outlines provide information on the location of the parking spaces. The plans are an integral part of these bylaws.
§ 2 Period of use
The parking spaces may be used from 6.00 a.m. to midnight. Night-time parking is therefore prohibited in all parking lots outside the hours of use.
§ 3 Behavior in the parking lots, special regulations
- Everything that impairs or endangers safety, order, peace and cleanliness must be avoided in the parking lots.
(2) In particular, it is prohibited in the parking lots:
- park vehicles outside the parking lots;
- to spend the night, pitch tents and park caravans and other trailers;
- carry out technical maintenance, repairs and cleaning on vehicles;
(3) Upon request, the Bad Tölz-Wolfratshausen District Office may allow an exception to the prohibitions in paragraph 2 in individual cases if there is no reason to fear any significant impairment of the parking lot or the parkers.
(4) The exception must be granted in writing and may be subject to conditions or revoked at any time if this is necessary to protect the parking spaces or the parkers.
(5) For the enforcement of the actions, tolerations or omissions prescribed in these statutes, the provisions of the Bayer. Administrative Service and Enforcement Act.
§ 4 Restriction of use
The parking areas may be closed to general use in whole or in part during certain periods; in such cases, use is prohibited in accordance with the closure.
§ 5 Liability
Use of the parking lots is at your own risk at any time of the year. The district of Bad Tölz-Wolfratshausen is only liable within the framework of the statutory provisions and its duty to ensure road safety.
§ 6 Fees
- Fees are charged all year round.
- Charges for the use of parking spaces are regulated by a separate set of charges.
§ 7 Arrangements
- The orders issued by persons authorized by the Bad Tölz-Wolfratshausen District Office to maintain safety and order must be complied with immediately.
- The supervisory staff may expel persons from the parking lot who, despite warnings, violate the provisions of these regulations or impair the purpose of the parking lot.
§ 8 Obligation to remove, coercive measures
- Anyone who causes an irregular situation by contravening these bylaws must immediately remedy this at their own expense without being requested to do so.
- The provisions of the Bavarian Administrative Service and Enforcement Act shall apply to the enforcement of the acts, tolerations or omissions prescribed in these bylaws.
§ 9 Administrative offenses
(1) Any person who
1. violates the rules of conduct of § 3 para. 1 or the prohibitions of § 3 para. 2;
2. does not comply with the requirements of the supervisory staff in accordance with § 7;
(2) The administrative offense may be punished with a fine in accordance with Art. 18 Para. 2 of the County Code.
§ 10 Entry into force
These user regulations shall enter into force on the day following their publication in the official gazette of the district of Bad Tölz-Wolfratshausen.
