Immission control; transmission of the results of emission monitoring for an installation requiring a permit

If you operate an installation in accordance with the Industrial Emissions Directive, you must submit an annual summary of the results of emission monitoring and other data to the competent authority to check compliance with the permit requirements.

If an emission limit value, an emission value or an emission limit is determined above the emission bandwidths specified in the BAT conclusions, the summary of the results of the emission monitoring shall allow a comparison with the emission bandwidths specified in the BAT conclusions.

You do not need to submit the annual summary of emission monitoring results if you have already submitted it to the competent authority under other legislation.

You are the operator of a plant in accordance with the Industrial Emissions Directive.

None. The administrative service is a real act against which no legal remedy is possible.

• You submit emission monitoring information and other data necessary to verify compliance with the permit requirements to your competent authority.
• The competent authority will check the documents you submit.
• If the emission limit values set are above the emission bandwidths specified in the BAT conclusions, the competent authority will compare your submitted summary with the BAT conclusions.

If, contrary to the summary specified in the Federal Immission Control Act (BImSchG), you do not submit the data specified therein to the competent authority, or do not submit it correctly, completely or on time, you are committing an administrative offense.

There is no statutory processing time.
