Brief description
If you want to open or take over a pharmacy, you must apply for an operating license.Description
Anyone wishing to run a pharmacy, whether as owner, leaseholder or manager, requires a license in accordance with the Pharmacy Act. This permit must be applied for at the local district administrative authority (district administration office, independent city).
The pharmacy may not be opened until it has been inspected by the competent authority and the latter has certified that the pharmacy meets the legal requirements.
The permit can also be withdrawn or revoked by the competent authority under certain conditions.

Medical certificate
This must expressly state that you are physically and mentally fit to run a pharmacy, and free from addiction
Extract from the Central Trade Register
Official certificate of good conduct
Identity card or passport
Confirmation from the Chamber of Pharmacists of the activities registered with it and statement on reliability
Affidavit
This is to confirm that you have not entered into any agreement that violates Section 8 sentence 2, Section 9 (1), Section 10 or Section 11 of the German Pharmacy Act. 1, § 10 or § 11 ApoG and that you have submitted the purchase or lease agreement for the pharmacy and, at the request of the authorities, other contracts relating to the establishment and operation of the pharmacy. The affidavit is best submitted in person to the district administrative authority
Declaration on the operation of other pharmacies
You must state in writing whether you operate one or more pharmacies in another Member State of the European Union or in another signatory state to the Agreement on the European Economic Area or in a signatory state to which Germany and the European Union have granted a corresponding legal entitlement by treaty, and if so, at what location
Curriculum vitae
with details of training and previous professional activity, in particular proof of pharmaceutical activity in the last two years prior to submitting the application
Plans
- Official site plan of the property with exact location (only required for the construction of a new pharmacy)
- Construction drawing of the planned operating rooms
- The intended use and the respective size (square meters) of the rooms must be specified. However, this is generally only required for newly built pharmacies
- Proof of premises (original or certified copy)
Proof of actual power of disposal over the pharmacy (original or certified copy)
- as owner of the pharmacy: purchase agreement, gift agreement, will
- as tenant of the pharmacy: Lease agreement
- Declaration by the lessor: The lessor must provide the district administrative authority with a written declaration of the reason for the lease (Section 9 (1) no. 1 ApoG)
- as administrator of the pharmacy: management contract
