4. purposes and legal bases of data processing
The enforcement of fishing law includes the issuing of fishing permits, permits for electric fishing, the administration of fishing leases and stocking measures, the appointment of fishing supervisors, the punishment of administrative offenses as well as exceptions to closed seasons and closed measures.
The data is collected on the basis of Art. 6 para. 1 sentence 1 letters c and e GDPR, Art. 4 para. 1 Bavarian Data Protection Act (BayDSG) in conjunction with the powers of the Bavarian Fisheries Act (BayFiG), the Ordinance on the Implementation of the Bavarian Fisheries Act (AVBayFiG), the Administrative Regulations on the Enforcement of Fisheries Law Provisions (VwVFiR), the District Fisheries Ordinances and the Administrative Offenses Act (OWiG).
5. categories of personal data that are processed
The fishing authority processes the data of data subjects and parties involved in administrative offense proceedings, of proposed and appointed fishing supervisors, electric fishermen, executive boards of fishing associations and fishing cooperatives as well as landlords, tenants, landowners and other persons entitled to fish in rem. The surname, maiden name, first name, date of birth, place of birth, address, nationality, occupation, telephone number, email address and, in the case of minors, the name, address and family relationship of the legal representatives and, if applicable, the club name, address and status as a club member are recorded.
6. sources of the data
If the data does not originate from the persons concerned themselves, it is provided by registration authorities, the police, the central register of public prosecutors, the Bavarian State Office for the Protection of the Constitution and the Federal Central Criminal Register.
7. recipients or categories of recipients of the personal data
The personal data is processed within the authority by the responsible employees of Department 34, the hunting and fishing authority, the district treasury, IT and auditing. It may also be necessary to disclose the data to courts, public prosecutors' offices and the police. The data must be made available to legal representatives and other parties involved in the proceedings, as well as to other fishing authorities within their jurisdiction, security and specialist authorities, public prosecutors' offices, police and other persons authorized to fish, as well as to processors, such as Jüngling gbb GmbH & Co KG for the creation of ID cards.
8. transfer of personal data to a third country
A transfer to a third country is not intended.
9. duration of the storage of personal data
The retention period is based on the standardized file plan for Bavarian municipalities and district offices (EAPlAufbew). Under AplZ (file plan numbers) 755 to 759, retention periods of 10 years are generally provided for fishing law procedures. By way of derogation, a 30-year retention period applies to fishing leases (AplZ 7581) and 5 years for fishing permits (AplZ 7582). If special laws provide for other periods, deletion is based on the relevant statutory provisions.
10. rights of data subjects
According to the General Data Protection Regulation, you have the following rights: If your personal data is processed, you have the right to obtain information about the personal data stored about you (Art. 15 GDPR). If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR). If the legal requirements are met, you can request the erasure or restriction of processing and object to processing (Art. 17, 18 and 21 GDPR). If you have consented to data processing or a contract for data processing exists and the data agreement is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR). If you make use of your above-mentioned rights, the public body will check whether the legal requirements for this are met.
