Event room; notification of temporary use
Brief description
You must report an event with more than 200 visitors that is only to be held temporarily in a room that is not approved as an assembly room.
Description
The Ordinance on Places of Assembly provides for the possibility of temporary use of rooms that are not actually intended and approved for this purpose for the holding of events.
If events with more than 200 visitors are to be held in rooms that are not approved as assembly rooms and do not comply with the provisions of the Assembly Venue Ordinance, the lower building supervisory authority must be notified.
Notification is not required if the rooms have already been approved as a place of assembly and the approval includes the type of event. If events are held on a voluntary basis, a single notification is sufficient for regularly recurring, similar events.
Prerequisites
The temporary use of rooms for an event with more than 200 visitors must be notified if
- the rooms do not comply with the regulations of the Assembly Venues Ordinance and
- a building permit as an assembly room, which includes the type of event intended, does not exist.
Deadlines
There is no general, Bavaria-wide deadline for this type of notification. However, this should be agreed in good time in advance with the local building supervisory authority.
Required documents
The documents to be submitted may vary depending on the type and size of the event and the venue.
This should be agreed in good time in advance with the local building supervisory authority.
Costs
Confirmation of receipt of the advertisement is free of charge.
Any safety measures ordered are subject to a fee.
Legal basis
Procedure
The notification with any necessary documents must be submitted to the responsible lower building supervisory authority.
As part of the notification procedure, the building supervisory authority checks whether the event can be held as planned. It confirms receipt of the notification to the operator or organizer and informs them whether it intends to take safety measures.
