Administrative costs; cost collection in the municipality

Municipalities, counties, districts, special-purpose associations, other local authorities and institutions under public law may charge costs (fees and expenses) for activities within their own sphere of activity that are carried out in the exercise of official authority (official acts). The charging of costs must be regulated by a cost statute (Art. 20 Cost Act). Administrative fees are a charge for the general expenses incurred by the authorities involved in carrying out official acts. The amount of the administrative fees is determined by the respective cost statutes, which may include a list of costs as an annex. The disbursements are the expenses of the authorities involved that are not already covered by the fee (e.g. costs for expert opinions, fees for telecommunications services or postal delivery orders).

You can obtain the relevant cost statutes and the list of costs from your municipality, your district office, your district, the special purpose association, the other local authority or institution under public law.

Official acts carried out by municipalities, counties and districts on behalf of the state are subject to costs in accordance with Art. 1 Para. 1 Sentence 3 of the Costs Act.

However, the amount of the fee is not specified in the municipal cost statutes, but is based on the (state) cost schedule, which is issued by the Bavarian State Ministry of Finance and Home Affairs in accordance with Art. 5 Para. 1 of the Cost Act and published in the Law and Ordinance Gazette (GVBl).
