Processing of personal data
in accordance with Articles 13, 14 and 21 of the General Data Protection Regulation (GDPR)

The Free State of Bavaria supports sports activities in sports and shooting clubs in the form of club lump sums. Applications for the club lump sum are submitted to the district administrative authorities. The district administration office also processes personal data in these administrative procedures.

4. purposes and legal bases of data processing
The data is processed in the application procedure. The funding request is checked against the funding guidelines and a final decision is made on eligibility for funding.
The data is processed on the basis of Art. 6 para. 1 subpara. 1 lit. c and e GDPR, Art. 4 para. 1 and Art. 5 para. 1 sentence 1 no. 1 BayDSG as well as the guidelines on the granting of grants by the Free State of Bavaria for the promotion of organized sport (sports promotion guidelines) of 5 December 2022, ref.: H2-5880-1-20.
5. recipients or categories of recipients of the personal data
Personal data of club board members, club representatives and trainers are processed. The processing includes names, date of birth, address, contact details, club affiliation, function of the data subjects and bank details. The ID number and type of license are also processed for training instructors.
The personal data is used internally at the Bad Tölz-Wolfratshausen District Office. The employees of Department 52, Office for Youth and Family, are responsible for the administration of incoming applications. Data may be transferred within the authority in justified cases (e.g. to the district treasury, audit, data protection officer, etc.). However, it may also be necessary to make the data available to external bodies, e.g. other district administrative authorities, the government of Upper Bavaria, supervisory authorities, the Bavarian State Data Protection Commissioner or the Bavarian Court of Audit.

7. sources of the data
If the data does not originate from the data subjects themselves, it will be provided by representatives of the person authorized to submit the application as part of the application procedure.
8. duration of the storage of personal data
The retention period is based on the general requirements of the standardized file plan for Bavarian municipalities and district offices (EAPlAufbew). A 10-year retention period is provided for under file plan number (AplZ) 520 Sportbetrieb and AplZ 5200 Sportförderung. If special situations or special legal regulations require a different period, the retention period is based on the relevant provisions.
9. rights of data subjects
According to the General Data Protection Regulation, data subjects have the following rights: If personal data is processed, they have the right to obtain information about the personal data stored about them (Art. 15 GDPR). If incorrect personal data is processed, data subjects have the right to rectification (Art. 16 GDPR). If the legal requirements are met, the deletion or restriction of the processing can be requested and an objection to the processing can be lodged (Art. 17, 18 and 21 GDPR). If consent to data processing has been given or a contract for data processing exists and the data agreement is carried out using automated procedures, the data subject may have a right to data portability (Art. 20 GDPR). If persons have consented to the processing of their data and the processing is based on this consent, the consent can be revoked at any time for the future. This does not affect the lawfulness of the data processing carried out on the basis of the consent until revocation. If the above-mentioned rights are exercised, the public body will check whether the legal requirements for this are met.

10. obligation to provide the data
The personal data is provided voluntarily by the data subject. There is no obligation to provide such data. If important information is not provided, it will not be possible to check the club's entitlement to a lump sum from the Free State of Bavaria. As a result, no final decision can be made on the application and consequently no grant can be made in accordance with the sports funding guidelines of the Free State of Bavaria.
