Processing of personal data

4. purposes and legal bases of data processing

The district advisory service for horticulture and landscape conservation has the following tasks:

  • Opinions on green spaces in the context of planning permission procedures
  • Carrying out regular inspections of natural monuments, including commissioning expert opinions and maintenance measures in cooperation with the lower nature conservation authority
  • Management of the Bad Tölz - Wolfratshausen District Association for Horticulture and Landcare
  • Public relations and educational work
  • Organization and implementation of events, such as the "Open Garden Day"
  • Project work such as the establishment and development of the Benediktbeuern fruit variety ark, houses in cooperation with Apfel-Birne-Berge and ZUK Benediktbeuern, as well as the organization and implementation of natural garden certifications
  • Advice for municipalities and citizens

The data processed within the scope of these tasks is processed on the basis of Art. 6(1)(c) and (e) GDPR, Art. 4(1) sentence 1 BayDSG in conjunction with Art. 51 para. 3 no. 3 LKrO processed.

5. categories of personal data that are processed

In this procedure, only data that is necessary for the fulfillment of the tasks of the District Advisory Office is processed. For the purposes of nature conservation and landscape management, this includes personal data, contact details and other relevant data of enquirers, people seeking advice, garden owners, course participants, full-time and voluntary workers and public officials.

As a rule, the data comes from the data subjects themselves.

7. recipients or categories of recipients of the personal data

The processing of personal data is carried out by the employees of the District Office, in particular the District Advisory Office for Horticulture and Landscape Conservation, in Department 35, the lower nature conservation authority. If external parties are commissioned with tasks, the employees of the processor also have access to the data. In justified cases, data may also be disclosed to enquirers, those seeking advice, garden owners, full-time and voluntary workers and those involved in a special way.

8. transfer of personal data to a third country

The transfer of personal data to a third country or to an international organization is not intended.

9. duration of the storage of personal data

The personal data will be stored temporarily for as long as the above-mentioned purpose requires. If the data subject requests early erasure or withdraws consent previously given, the data will be erased earlier. Otherwise, the duration of storage is based on the standardized file plan for Bavarian municipalities and district offices (EAPlAufbew). A retention period of 30 years for fundamental issues (APlZ 7240) is provided for fruit growing and horticulture under AplZ (file plan reference number) 724. A 10-year retention period is specified specifically for the area of district technical advisors (APlZ 7241).

10. rights of data subjects

According to the General Data Protection Regulation, data subjects have the following rights:

If their personal data is processed, data subjects have the right to obtain information about the personal data stored about them (Art. 15 GDPR). If incorrect personal data is processed, data subjects have the right to rectification (Art. 16 GDPR). If the legal requirements are met, data subjects can request the erasure or restriction of processing and object to processing (Art. 17, 18 and 21 GDPR). If they have consented to data processing or a contract for data processing exists and the data agreement is carried out using automated procedures, data subjects may have a right to data portability (Art. 20 GDPR). If the above-mentioned rights are exercised, the public body will check whether the legal requirements for this are met.

11. obligation to provide the data

There is no legal obligation to provide personal data. However, the data is required for establishing contact and providing information. If the required data is not provided, it may not be possible to provide the expected services.
