4. purposes and legal bases of data processing

Your data will be processed for the following purposes as part of species protection enforcement:

  • Issue of marketing, transportation and ownership certificates
  • Monitoring trade
  • Processing of stock reports
  • Checking the posture

Your data is collected on the basis of Art. 6 para. 1 sentence 1 letters c and e GDPR and Art. 4 Bavarian Data Protection Act (BayDSG) in conjunction with §§ 46 ff Federal Nature Conservation Act (BNatSchG) and the Federal Species Protection Ordinance (BArtSchV), as well as

  • Council Regulation (EC) No. 338/97 of December 9, 1996 on the protection of species of wild fauna and flora by regulating trade therein (EC Species Protection Regulation)
  • Regulation (EC) 865/2006 laying down detailed rules for the implementation of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein (EC Wildlife Enforcement Regulation)
  • Commission Implementing Regulation (EU) No 792/2012 of 23 August 2012 laying down rules for the format of permits, certificates and other documents pursuant to Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein and amending Commission Regulation (EC) No 865/2006.

5. categories of personal data that are processed

The public body processes the following personal data from you: Surname, first names, date of birth, place of birth, address, telephone number, fax number, email address and, in the case of tradespeople, accounting records where applicable.

6. sources of the data

The processed data originates from the data subjects themselves. They are collected as part of an application procedure. If the species conservation authority takes action on its own initiative and the administrative procedure is not initiated by the data subject, the data originates from other species conservation authorities, customs or the police, or the data is transmitted by third parties, possibly also by those who have reported the incident.

7. recipients or categories of recipients of the personal data

Your personal data will be processed within the authority by the employees of Department 35 - Lower Nature Conservation Authority - and the district treasury. If necessary, the data will also be forwarded to other species protection authorities in Germany and abroad. If there is reason to do so, the data must be forwarded to the police, courts and public prosecutors. Registration authorities in Germany and abroad are contacted to establish identity. If there is a need to verify the origin or species-appropriate husbandry, information must also be provided to manufacturers, breeders, dealers and veterinary authorities.

9. duration of the storage of personal data

The retention period is based on the standardized file plan for Bavarian municipalities and district offices (EAPlAufbew). A retention period of 30 years is provided for under file number 1734.

10. rights of data subjects

According to the General Data Protection Regulation, you have the following rights: If your personal data is processed, you have the right to obtain information about the personal data stored about you (Art. 15 GDPR). If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR). If the legal requirements are met, you can request the deletion or restriction of processing and object to the processing (Art. 17, 18 and 21 GDPR). If you have consented to data processing or a contract for data processing exists and the data agreement is carried out using automated procedures, you have the right to data portability (Art. 20 GDPR). If you make use of your above-mentioned rights, the public authority will check whether the legal requirements for this are met. You also have the right to lodge a complaint with the Bavarian State Commissioner for Data Protection.
