Processing of personal data
in accordance with Articles 13, 14 and 21 of the General Data Protection Regulation (GDPR)

The expert committee at the Bad Tölz-Wolfratshausen District Office collects data on property transactions and evaluates them anonymously in the purchase price collection. The purchase price collection serves as a working basis for determining real estate values (standard land values, market reports).

4. purposes and legal bases of data processing
The purpose of the processing is the management of the purchase price collection by the expert committee. Questionnaires and deeds are evaluated in order to determine standard land values and other data. Authorized applicants receive information from the purchase price collection.
The data is processed on the basis of Art. 6 para. 1 sentence 1 letters c and e GDPR, Art. 4 of the Bavarian Data Protection Act (BayDSG) in conjunction with Sections 193 para. 5, 195, 196 and 197 of the German Building Code (BauGB) and Sections 10, 11, 12 and 13 of the Ordinance on the Expert Committee (BayGaV).
5. categories of personal data that are processed
The public authority processes the surname, first name, date of birth, place of birth and address of the seller and purchaser of land. The contents of contracts or deeds in which someone commits to ownership of a property are recorded. The contents of agreements before decision-making authorities or decisions by expropriation authorities, decisions in reallocation proceedings or compulsory auction proceedings are also collected.
The following personal data of applicants is processed: Surname, first name, address, telephone number, fax number, email address, their function and the interests entitling them to information, details of the valuation object, certification, valuation order, other details provided in the application procedure. In some cases, photos of properties/buildings are taken for the purpose of maintaining the purchase price collection.
6. sources of the data
The processed data originates from contracts sent to the office of the Expert Committee by notaries. They also originate from persons who are obliged to provide information and who are requested to answer questionnaires, from experts, authorities and courts. The data is also knowledge of the office or the expert committee that is submitted.
The notarizing bodies are obliged to send copies of documents to the expert committee (§ 195 Para. 1 BauGB). Experts and persons who can provide information on the matter also have an obligation to provide information or documents to the expert committee.
7. recipients or categories of recipients of the personal data
Your personal data will be processed internally by the employees of the office of the expert committee, the members of the expert committee and the district treasury. They are passed on to persons entitled to receive information, authorities, courts and the judiciary, as well as to the tax office, the Federal Statistical Office and the State Statistical Office.
8. transfer of personal data to a third country
The transfer of data to a third country is not intended.
9. duration of the storage of personal data
The notifications and documents sent by the notarizing bodies, as well as notifications from the land consolidation authorities, are stored for 3 years. They are then destroyed. The period begins at the end of the year of transmission (§ 10 Para. 2 BayGaV). Otherwise, storage is governed by the provisions of the standardized file plan for Bavarian municipalities and district offices (EAPlAufbew). A 10-year retention period is provided for under AplZ (file plan code) 6120 (expert committee) and a 5-year retention period under 6121 (standard land values) and 6123 (purchase price collection). If special laws provide for a different period, deletion is based on the relevant statutory provisions.

You have the following rights under the General Data Protection Regulation:
If your personal data is processed, you have the right to obtain information about the personal data stored about you (Art. 15 GDPR). If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR). If the legal requirements are met, you can request the erasure or restriction of processing and object to processing (Art. 17, 18 and 21 GDPR). If you have consented to data processing or a contract for data processing exists and the data agreement is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR). If you make use of your above-mentioned rights, the public body will check whether the legal requirements for this are met.

11. obligation to provide the data
Applicants are not obliged to provide their data. However, your details are required in order to process the requests. Otherwise, the request for information must be rejected.
