Processing of personal data
in accordance with Articles 13, 14 and 21 of the General Data Protection Regulation (GDPR)

The Bad Tölz-Wolfratshausen District Office collects personal data from applicants in connection with the promotion of housing in accordance with the Bavarian Housing Promotion Act.

4. purposes and legal bases of data processing

Data processing is carried out to carry out the application and approval process with the help of BayernLabo's service portal.

The data is processed on the basis of Art. 6 para. 1 sentence 1 letters c and e GDPR and Art. 4 para. 1 Bavarian Data Protection Act (BayDSG) in conjunction with Art. 21 Bavarian Housing Promotion Act (BayWoFG).

5. categories of personal data that are processed

The public body processes the following personal data relating to the applicant: Surname, first name, address, tax identification number, occupation, contact details (telephone number, email address), bank account details, identity document, other personal details provided by the applicant to substantiate eligibility to apply (about liabilities, assets, income, current living conditions, health restrictions) as well as details of the project, property, building permit, financing plan, technical description, extract from the land register, proof of ownership and cost estimates.

6. sources of the data

The processed data originates from the data subjects themselves. They are collected as part of an application procedure.

There is no obligation to provide the data. If important information is not provided, this may mean that the application for housing assistance cannot be fulfilled.

7. recipients or categories of recipients of the personal data

Your personal data will be processed internally by the responsible employees of the Housing Department, the Building Authority, the Valuation Committee office and members of the Valuation Committee. The Audit Office and the Audit Committee must be involved for auditing and data protection purposes. Legal disputes are settled before the competent courts. In the case of supervisory measures, the superior (financial) authorities must be involved. The Landesbodenkreditanstalt makes the final decision on the approval of funds and disburses them.

8. transfer of personal data to a third country

The transfer of data to a third country is not intended.

9. duration of the storage of personal data

The retention period is based on the standardized file plan for Bavarian municipalities and district offices (EAPlAufbew). A 10-year retention period is regulated under AplZ (file plan reference) 66 (housing promotion). If special laws provide for a different period, deletion is based on the relevant statutory provisions. The data collected by the licensing office is deleted when it is no longer required for the fulfillment of tasks or at the latest when the statutory retention period expires.

10. rights of data subjects

According to the General Data Protection Regulation, you have the following rights: If your personal data is processed, you have the right to obtain information about the personal data stored about you (Art. 15 GDPR). If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR). If the legal requirements are met, you can request the erasure or restriction of processing and object to processing (Art. 17, 18 and 21 GDPR). If you have consented to data processing or a contract for data processing exists and the data agreement is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR). If you make use of your above-mentioned rights, the public body will check whether the legal requirements for this are met.
