Photography and filming

Certain rules apply to commercial photography and filming in the great outdoors, which you should think about in advance. An overview of the most important guidelines shows what needs to be observed.

General information:

  • Consent of the landowner is required, as commercial activities are not covered by the general right of access (No. 2.4 of the announcement of the Bavarian State Ministry of the Environment and Consumer Protection on the implementation of the Bavarian Nature Conservation Act of 27.11.2020). At Walchensee and in the Karwendel, these are primarily the Bayerische Staatsforsten A.ö.R., Bad Tölz forestry operation
  • the habitats of wild animals and plants must not be impaired or destroyed without good reason (§ 39 BNatSchG); information on the locations of habitats can be provided: Lower Nature Conservation Authority
  • wild animals of strictly protected species and European bird species must not be disturbed during the breeding, rearing, moulting, hibernation and migration periods (Section 44 BNatSchG); information on habitats and sensitive periods can be obtained from the lower nature conservation authority

Drones:

  • According to Section 21h (3) No. 6 of the German Air Traffic Regulations (LuftVO), operations over nature conservation areas and Natura 2000 areas (FFH and bird sanctuaries) are only permitted to a limited extent
  • In accordance with Section 21h (3) No. 5 LuftVO, the approval of the responsible authority is required for operations above and at a lateral distance of 100 m from federal highways and railroad facilities. In the case of federal highways, this is the Weilheim State Building Authority. In the case of railroad facilities, it is likely to be Deutsche Bahn (see https://www1.deutsche bahn.com/dbsicherheit-de/Unsere_Leistungen/Weitere-Leistungen/02_Multicopter-3269322)

Landscape and nature conservation areas (LSG or NSG)

  • Permissibility depends on the respective protected area ordinance. The protected area ordinances can be viewed on the Bad Tölz-Wolfratshausen LRA homepage.
  • Permission is required for commercial filming and photography in the Karwendel and Karwendel foothills nature reserve and in the Isarauen nature reserve between Schäftlarn and Bad Tölz
  • Depending on the protected area ordinance, the approval of the lower or higher nature conservation authority may be required
  • Generally in LSG and NSG: Prohibition of changes to nature and landscape, leaving areas dedicated to public traffic with motorized vehicles, overnight stays, making fires

The protected area boundaries can be viewed in the BayernAtlas(https://geoportal.bayern.de/bayernatlas/?lang=de&topic=ba&bgLayer=atkis&catalogNodes=11,122; change topic -> Environment -> Nature -> Select protected area category).
